Terms of Service

The service

ImageGenAI lets you create pictures from text descriptions (text to image) and from text together with reference images (image to image). You can use it as a guest, with a free account, or with a paid plan. Features, limits and prices may change as the service develops.

Who can use it

You must be at least [[TBD-MIN-AGE]] years old and able to form a binding contract. If you use the service for an organization, you confirm that you may bind it.

Guests, accounts and fair use

When you generate without signing in, we create a guest session for you. Guest sessions are meant for individual, human use. You may not create many sessions or accounts to gather free credits, use scripts or bots to generate images, or bypass limits and human checks. We may limit, suspend or end access when we see this.

If you sign in, keep your credentials safe. You are responsible for activity under your account. Work created in a guest session can be moved to your account when you sign in on the same browser; we do not promise to recover work in other cases.

Credits, plans and payments

Generations are paid for with credits. The cost of an image is shown before you confirm it.

• Free credits: guests receive 60 credits for each rolling 24 hours. Signed-in accounts can claim a daily check-in of 30 credits that expires at midnight, and receive a one-time signup bonus of 30 credits. Free credits have no cash value, cannot be transferred, and may be changed or withdrawn.
• Subscriptions: a paid plan gives credits for each billing period. Unused plan credits do not carry over after the period ends. Plans renew automatically until cancelled.
• Credit packs: one-time purchases that add credits to your balance and expire 365 days after purchase.
• Prices and tax: prices are shown at checkout, including taxes where required. Current plan and pack prices are listed in the ImageGenAI price list.
• Failed generations: should a task fail because of a fault on our side, its credits go back to your balance automatically.
• Cancelling: you may cancel at any time; the plan then ends at the close of the paid period.

The free plan: size and public images

Free use is limited to 1K image size. Images created on the free plan, whether as a guest or with a free account, are public by default. By generating them you agree that they and their prompts may be displayed in a public gallery after review, and that other people may view them. Paid plans can keep results private. Do not enter private, confidential or personal information into a free prompt.

Your content and our license

You keep the rights you have in the prompts and reference images you provide, and you promise that you have the right to use them. You give us a worldwide, non-exclusive license to host, process, reproduce and display your content and the pictures generated from it as needed to run the service, and, for public images, to show them in the gallery. Generated pictures may be similar to pictures made for other people from similar prompts, and we cannot promise that a picture is unique or that it is free of third-party rights. [[TBD-COMMERCIAL-USE-TERMS]]

Acceptable use

You agree not to use the service to create, upload or share:

• sexual content, nudity or anything sexualizing minors, in any form;
• content that depicts or imitates a real person in a way that could deceive, harass or harm them, including fake evidence;
• hate, harassment, threats, graphic violence or content that promotes self-harm;
• content that infringes copyright, trademarks or other rights, including protected characters and living artists' work;
• malware, spam or deceptive material, or anything unlawful.

Prompts and images are checked by automated tools and may be reviewed by people. We may block, remove or report content, and end access. Report a problem at [[TBD-ABUSE-EMAIL]].

AI output has limits

Pictures are generated by a model. They can contain errors, odd details, garbled text and unexpected content, and they are not real photographs of real events. Do not present them as evidence or as depicting actual people or events.

Storage of your work

Guest work stays in your history for 7 days. For accounts, history is kept [[TBD-STORAGE-DAYS]]. We may delete files that are expired, unlawful or in breach of these terms. Download what you want to keep.

Our rights

The site, its software, design, name and logo belong to us or our licensors. These terms do not give you any right to them except to use the service as offered.

Copyright complaints

If you believe a public image infringes your rights, send a notice to [[TBD-DMCA-EMAIL]] with your contact details, a description of the work, the location of the image on our site, a statement of good faith, and a statement that the information is accurate. We may remove the content and end the access of repeat infringers.

Third-party services

The service relies on third-party providers, for example for AI processing, payments and hosting. We are not responsible for their independent terms or actions.

Suspension and termination

You may stop using the service at any time. We may suspend or end access if you break these terms, if the law requires it, or to protect the service. Rights that should survive, such as limits of liability, continue after termination.

No warranty

The service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We do not promise that it will be uninterrupted, error-free or fit for a particular purpose.

Limits of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for loss of profits or data. Our total liability for any claim is limited to [[TBD-LIABILITY-CAP]]. Nothing here limits liability that cannot be limited by law, including for consumers in the EU and UK.

Your responsibility

You agree to cover claims, losses and costs that arise from content you provide or from your breach of these terms, to the extent the law allows.

Governing law and disputes
